In the US, if you were under an investigation and the government put a legal bug in your house and you found it would it be illegal to destroy it?
Yup, since it's government property.
But you wouldn't know it was unless they told you, in which case you wouldn't say anything important near it anyway, eh?
True; but say the bug falls off wherever it's hidden and you step on it and break it; they could still arrest you for that, even if it was a complete 'accident'.
Not that I know of. Unless they can
prove
that you did it maliciously, they couldn't do anything. Not to mention, if they don't have probable cause they wouldn't be able to put one in there in the first place.

Unless they decide you are a terrorist and decide to go Patriot Act on your apartment.

They /could/ go Patriot Act on you, but they still need to have evidence pointing to you being a terrorist.

If they're bugging you and you don't know about it, aren't they *already* going Patriot Act on you?

No. There are other legal means to bug people besides Patriot Act. In fact, I doubt the agency that placed the bug would bother with the Patriot Act, which is politically volatile. More likely, the agency would obtain a warrant.

Legal without knowledge/consent? I'm not fishing for anything, I just don't know the answer, so I'm curious.

Yes, with a warrant, at least, in the jurisdictions I am aware of.
