Yes sir,
I have read the FAQ'a which states :
In order to be hitcapped against a raid boss (considered +3 your level), you require 17% hit, or 289 rating. If you have a Draenei in your group, this is reduced to 263.
However why is it that on my character screen does it say that with a hit rating of 397 I only have 15.13%.
I know I could possible just be being a noob or perhaps being a lazy noob in your eyes but I have been trying to read up on all the forums I can today trying to find out the answer.
Perhaps I should state my question like this:

Shadow priests have several talents (when spec'd properly) that allow for lower hit rating necessary on gear so that we can itemize for other stats like haste and crit. While 17% is necessary for all spell casting classes, Shadow priests as a class earns an additional 3% out of
shadow focus
and a further 3% out of
misery
.
This brings us from 17% - 6% or 11% really what we need from our gear (again, assuming you've spec'd for Misery and Shadow Focus, which any self-respecting spriest has already done!).
11% is for players who are NOT Draenei or who do not have a Draenei in their group. Subtract an additional 1% for this.
in other words, a small expounding on what Valandilv wrote.
It is also within the link that I provided.
Edit: it occurs to me that you may have misunderstood the 17% 289 hit rating statement.
What you NEED is 11% (assuming proper talents) which is equal to 11 x 26.232 = 288.5 or rounded up is 289. 17% would be 446 hit rating, which is clearly way higher than what shadow priests require, but it IS what Fireball mages (for instance) require.

A great big thank you for all your advice guys finally undertsnad it all now I best start thinking about reducing my Hit and replacing it with something more of use.

Always happy to help.
I'd recommend calculating how much you have gemmed in Hit versus how much you have GEARED for hit and try to figure out how much it is that you can lose per item or per gem slot to drop down to your 11%. or you can start swapping out gear if you have spares just to experiment.
If your +hit gear (minus gems) is close to the hit cap, maybe just regemming may be the solution. :-)
