No. There are other legal means to bug people besides Patriot Act. In fact, I doubt the agency that placed the bug would bother with the Patriot Act, which is politically volatile. More likely, the agency would obtain a warrant.

Yup, since it's government property.
But I bet it would be hillarious to just grab it, and yell at it at the top of your lungs to scare the crap of/burn the ears of/piss off, whoever was listening :P
