if it is alliance, i ask if they are after the mine node, if not and they are fighting something next to it, i help kill it so they do not die and i still have to kill it. if it is horde, well, it depends if i know the name of the horde character. if it is someone i know, i leave it. otherwise, fair game.

Here's what I do, but I'm a pally so might not help. While mining, someone either faction (PVE server) will try to cut in while I'm looting. There's a minute amount of time where that person can cut in before you start to swing the pick. When the loot window pops up, I just wait, I know they're spamming the mining action, but they can't because WoW considers the node 'in use'. So you can wait indefinitely, make sure your furthest from the mob, or you can try timing it to where you'll get the next swing in before they do.
Note that, on the Isle, you can time the nodes, so while they're waitin to cut in front of you, they're wasting twice the time, because someone else is getting the other mine. One other thing, I've now started to report them to other members of their guild. I know it annoys the uninvolve party but it's one way to get them to change their ways. If I the same person does it twice to me, I'll mention it in trade chat. How many guilds want there names associated with trash.

If Blizzard really wanted to solve the problem..they easily could have incorporated miner's rights into the game. It could work in the same fashion as kills..first to do damage gets the xp and drop. First to strike the node gets the ore. Of course this is for same faction only.
As for Ninja's who do stuff like flying down and stealing your node while your fighting off the ogre protecting it....well if you start to concern yourself with every idiot who plays this game you will find yourself doing nothing else..idiots are like a third faction in this game.
Level up your "tolerance" to 375 and dismiss them, don't let anyone interfere with your enjoyment of the game.

It's annoying but I guess part of the game. Personally, if I see someone at the node, I just move on to the next. No need to be rude. I've only had a node invaded once, and sadly it was by a fellow Horde.

My rogue is a miner, and I've learned to deal with node-ninjas in a variety of ways.
Cross-faction:
Node-ninjas are just a fact of life. If you play on a PvP server, kill them or die, whoever wins gets the node.
PvE, just spam that right-click and leave the loot window open (node-squatting) until they get irritated and move off. I've found that if you do this enough, the other faction's miners will start to recognize you as the guy who node-squats and they'll move on.
Same faction:
I have a macro to hit them with this line first: "Please do not start swinging on a node if someone else is already there, because it's very rude and poor mining etiquette." Most times, I get an apology and they move off.
If they keep going, make note of their name and guild, if they have one, and say something along the same lines as above, just stronger wording. "Hey! First come, first serve you node-ninja!" is what I usually use.
If they continue, at this point assume general asshattery, place them on ignore, and node-squat them like you would a cross-faction rival. Also, speak to a guild officer about them if you can. You can try spamming their name in Trade and the Realm-specific O-boards, but most of the time these last two tactics have very limited success, if they work at all.
Keep in mind, if another player continually follows you around and is always going after the nodes that you are, this can be considered griefing, although I'm not sure what, if anything, Blizz would do about node-griefing.

dang same faction? I'd transfer my account to another realm that realm sounds like a bunch of noobs. on my realm I have never had that problem even from the other faction its a given first come, let them mine then kill them

The first thing you should ask for is for Blizzard to label all of YOUR nodes so everybody knows they are yours. Maybe that will solve the problem. BTW, how do YOU tell your nodes from everybody else's? Are they all yours? ;)
