I think this.
If you can't handle x amount of players in the same place, then have x - y the total amount per server you can accept.
It's not Swifty's fault you can overload a server, it's your own. Sort it out. Free Swifty!

I'm confused about the whole thing. Was it just the number of players in one place that crashed the server, or was it something else? I don't really know how it all works, but when i watched his video it seemed to have something to do with hosting a live stream.

They host a live stream, and everyone wanted to play with Swifty so they all create level ones.
A few thousand of those in one place seems to be able to make the server crash.

Don't incite riots and you won't get banned, seems pretty simple to me.
Don't get me wrong, I've done something similar on another game, but we did it to protest what we felt was mistreatment by the company in not caring for their servers properly...not over an idea we wanted to push.

As far as I know, noone has stated that in-game celebreties cannot create events attracting lots of people - if the servers can't handle it, that's Blizzard's problem, and I don't think they should go around banning people over it. Especially with someone as famous as Swifty, where it's rather likely that it's going to give them trouble on the forums.
If they have, however, given Swifty multiple warnings on the matter, then the ban is completely justified.

Unless you personally made Swifty aware of each server's capacity at any given second of every day you have no right to ban him. You do realize that if Swifty sees fit he will be able to take legal action against the company...and win?
You banned the player who made so many people happy, they loved watching him, they loved playing with him, they loved everything that he stood for, a genuine good person and YOU Blizzard messed it all up, if you see fit to ban anyone? Why not ban every single account that was on the server at the time of the crash? Since they also contributed. That includes your "GM"s. I expect blue posts about "rules and regulations" "electronic signatures" "he knew what he was doing".
You BANNED ONE PERSON compared to an entire guild or an entire group of people when Swifty was the LAST PERSON to ever want to ruin ANYONES fun while gaming, the even is a pathetic excuse for lack of discipline with dealing with overpopulation. If you can't handle the popularity your game spurs FIND ANOTHER GAME TO TAKE OVER!

That is a surprisingly well-voiced opinion, given the fact that it's taken from well... The WoW-forums. I've got to say that I agree with the guy a bit; and I expect to see a ton of more posts just like that one.

Except they can ban you for no reason. Still, an "unrighteous ban" like this will only result in a mass unsubscription by Swifty's fans unless it's righted.

There is no breach of contract. If you play WoW you agreed to their ToU which state they can ban you whenever they want.
I'm not saying the ban was the right thing to do or not, I'm just saying that was nothing wrong with it legally (constitutionally or otherwise).
