If someone would not have bought the files in question otherwise, there really isn't a loss of sale. There isn't any lost in profits from the transport of the media to this non paying user because it's obviously not the company that's putting it up on p2p networks. That said, a big reason people wouldn't buy music, is because they
can
get it for free.
If I go and steal a watch that I did not plan on buying, would I be able to defend myself in court by saying that there was no loss in sale, since I did not actually plan to buy?

In that instance, a company would be losing profits on materials and transportation. It's not entirely analogous. If the company spent absolutely no money on making the watch and putting it there, that would be more analogous. For that instance, there's an old saying, "No harm, no foul".
Because one commodity is tangible and the other is intangible does not mean there is not a loss of commodity.

Point 1:
At some point someone agreed upon purchase that they would not distribute the product, under punishment of law, and they did. Illegal. End of story.

Answer 1 - What I pay for now is not what I pay for in the future, this is the point I was making.
Answer 2 - I meant that you only start paying taxes from paychecks etc. from the age of 16 (in Britain).
Yes, you will begin paying for it later, but you will still be paying for that same water you drink today, later in life. What I am saying, is you cannot escape the fundamental cost of anything, even music. EVERYTHING has a price. And, believe me, you will pay.

If I download a song, the artist does not lose the copy of the song.
If I steal a watch from a store, the store loses the watch.
How can you compare these two events?
If I download a song from Madonna, she doesn't know it. She'll never notice it, and nobody else will either. It's a non-existing item being duplicated into an exact copy. It doesn't exist. If you're thinking about icecreams, and I start thinking about icecreams too, then I didn't steal your thoughts! I merely started thinking of the same thing.
We've been coping eachothers music and games and movies for ages. Remember the old VHS-tapes? If they weren't copied, they were lent. Everybody in the neighborhood has seen it, and usually just one family bought it. That's socalled "piracy".
The industry has been fighting this for as long as it's been possible. When the VHS came, it would be the death of the cinema. When the CD came, it would be the death of concerts. Etc ad infinitum.

If 300K spoiled suburban kids download thier music offline, it probably won't affect Madonna, but the people who invested thier money in production, marketing, management, etc.... they WILL notice. In fact, they have felt it, tremendously. It has changed the way that the entertainment industry does business.
I think the fact that people try to rationalize stealing, and kids steal, and think that it is 'ok', because they are annonomous in a crowd, and they think that it doesn't hurt anyone (as if that matters), speaks very ill about the direction society is headed.
Take responsibility. Pay for what you aquire. It'll make a real man outa ya.

If those kids never had money to buy the record in the first place, they wouldn't notice it. But of course, they're kids. Of course they will download and abuse it all. I'm not a kid, however, and I pay for good music. Heck, I even go to concerts and buy tshirts and caps and all that. Because I support those I love, and ignore those I don't like.

Again with this stealing. It isn't stealing when they don't lose a physical object. In a worst case scenario, it's a "lost sale", not a "lost item". If the kids walked into the store, took a CD from the shelf, and ran for it, then yes, it would be stealing. If the kid logs onto Piratebay and downloads a song, then no, it's not stealing. If the kid listens to the song, and loves it, and doesn't buy it, it's plain rude. But, that's kids for you.
