Leaving Random Dungeon Groups

I have seen people that were healers or tanks que up some dps for a dungeon and then leave once the group is formed. This allows the dps to skip the 40 minute que and the tank and healer just eats the 30 minute deserter debuff. Is this a ban-able behavior aka violation of the terms of service or no?

I would barely even call this borderline abuse of game mechanics, much less an act that could get you outright banned. There's certainly nothing in the ToS stating you're required to spend any specific amount of time in dungeon groups before leaving, regardless of why you're joining or leaving in the first place.
Besides, it doesn't "hurt" anyone except the tank/healer and I'm sure they don't care about the debuff or they wouldn't be boosting in the first place.

What's worse is a DPS who Q as tanks and then informs everybody that a DPS needs to leave because he can't tank.

The tank gets kicked always when he dos that. Stupid dps to Q as tank. No use.

Can you ban a hunter that needs a tank back?
Can you ban a mage that needs a healer's ring?
What if the tank really wanted to run the whole instance, but his baby just started crying? This has happened to me. Will you ban from game people with babies under 2 years?
Any system that is based on "justice tables", such as the queue times, will be open for exploits.
It's people's behaviour that is the problem, but Blizz can't hotfix this, sadly.
