I was invited by a premium member, and as of, like, a month and a half ago, I was listening to my whole playlist, and my favorite 5-6 songs, nightly, without paying anything. I just got a commercial every 8 songs or so. Maybe the US version is different?

I don't think Skyrim is a very good example. If people pirate Skyrim, how do they get the bugs fixed?
Its pretty easy to find the updates the same way you would pirate the game ;p Every patch that has been released through steam is on any torrent site already.

The problem is that 90% of people, who were using "pirated" content from these sites, won't go and buy "proper" disks just in case their "free" video/whatever was cut off. They would rather not pay at all. Thus the figure of $480 million isn't trustworthy at all.

Same principle applies to any other game, generally speaking. It especially applies to consoles, which tend not to get patched nearly so often.

Skyrim didn't come with so many bugs that it required fixing. It was a very playable, very complete game out of the box. I cringe when I think of people ripping off Skyrim, because that is less $$ toward the next Morrowind.

Do you not accept that there are people who pirated it, who if it were not possible to pirate it, still wouldn't have bought it? Because that assumption is necessary to conclude that a download is equal to a lost sale.

I still think that the theft has occurred. Robbery is different from theft. Assuming your understanding of robbery/theft is the same. I would agree with you that there isn't always a financial loss, because that person wouldn't have bought the game otherwise, but that doesn't mean the act of taking the game wasn't a theft. So, I would agree with the marketing department. Are you assuming that because the game wouldn't have been bought had the theft not occurred that the theft is not actually a theft?

Let us not forget that if they are torrenting their pirated goods they are not only getting it for free but giving it to to others for free as well. It's now no longer easy for them to say 'I wouldn't have bought it anyways." now it's "I wouldn't have bought it...and I'm pretty sure the 2-250 people who got it from me wouldn't have either."
From my view sites like MegaUpload are softer targets yet less of a threat.

believe me, I have the same suspicions. Specially since now fileserver and filesonic have joined the flock of the damned.
