021/40 is a raid build.
It is not good at:
- Arenas
- Battlegrounds
- Farming
In order to be superior to UA/Shadowburn or Felguard, you need
- 202 spell hit
- 1000+ shadow damage
- 20% spell crit
without talents or buffs.
You are pre-kara. You do not have these things.

BGs aren't going to get you spell hit. There's zero spell hit on a warlocks PvP set that I can think of off the top of my head. Maybe the staff has some, don't remember, but its not as good an option overall as the spellblade.
I mentioned spellstrike to you in another thread, along with several other options for raising your spell hit. Spell crit will come naturally from PvE progression.

The staff has some spell hit on it, as does the spellblade and the dreadweave shoulders, but that's all.
Also, the only builds that really work in both PvE and PvP are UA and Felguard. Destro can work in PvP if you have excellent support and healers, but a DS/SnF build categorically will not work in PvP.

Don't use merciless leggings to raid with period. If you are interested in raiding stay affliction until you have...
203 Spell Hit
1100+ Shadow Damage (self buffed)
17% (3% talents) spell crit
Then go 0/21/40.

Due to shadow bolt scaling you will actually see more bennefit from going higher in spell damage then you will with getting more crit. Crit is ALWAYS the last thing you should worry about. Getting higher spell damage means more damage over all where as crit just improves crit damage. Having more damage over all means your crits even do more damage. Spell damage is the way to go period after you are hit capped...spell crit is just a bonus on items with high spell damage.

The point to the crit is the maintaining of ISB. When you're running a 0/21/40 build, one of your primary purposes is to maintain that buff on your target. This provides a significant20% benefit to all shadow users.
25% with talents is a bare minimum for this.
But no, you don't give up much spell damage for crit in most circumstances. It's a natural accumulation once you've moved on to middle and endgame raids. We agree that the focus is on hit to the cap, then damage.

In our guild we have played around a lot with destro/affl-builds and tried it out on very different levels of gear and what we have found out is that in more or less full kara gear (~150 hit, ~1100 shadowdmg, ~15-20% crit) the destro does higher dps. On earlier levels of gear we were quite on par (with all crafted and only one or two kara-pieces) on our dps. Destro is also generally speaking easier to play, to really max out damage with affliction you need good timing with all your dots.
You've hit upon a very important point there - it very much depends on whether you are playing it exactly right and whether your playstyle really gels with the spec to make maximum possible damage. Many people's experience will be the opposite of this.
