Because we cannot be sure when the embryo is in a state where it would have rights(in this case, human), but we know that the mother always has them in this scenario.
This is important. You can't just infringe upon someone's rights without having a high degree of confidence. I do err on the side of caution - the mother's rights are being infringed upon, so without being absolutely sure that abortion is killing a human being, you cannot justify the infringement. I think of it like the rational behind wire tapping - unless you are beyond sure that there is something going on that you need to stop by wire tapping, then you can't justify infringing their right to privacy, regardless of the potential cost.

Analogy:
A private home collapses. There may have been a person in the house, no one's sure. Can the owner of the house call upon his right to private property rights and not allow the firemen to search for the person?
Even if there is a possibility of a person not being there, the possible person's right to life/rescue trumps the owner's right to private property.

I don't know, can he? Even if he could, we already know that law and ethics aren't perfectly aligned.

I'm not so sure. If the person in the house was infringing upon the owner's rights at the time by being there without the owner's consent, the way I see it the owner's right trumps since whomever infringed upon the other person's right is the one who must sacrifice their own right should one be required to be forfeited. Just like in the original case, the mother's right supersede the fetus's right (if it even has one) because the fetus is infringing upon the mother's right.

My dog acts like that too. You have to be careful when applying emotions to animals, or even humans. The problem is that you have to answer this:
What is an emotion?

You're right. We don't contaminate its air, we don't pollute its water, we don't destroy its forests, and we don't kill it's wildlife.
