The cap when using vsync is usually the refresh of your monitor which is around 60Hz if it's an LCD. Sitting at 40fps would not be caused by the vsync setting.
What's your hardware and video settings? Where do you see the 40fps and does it ever go higher or lower?

/console maxfps 0 to remove any limit that you may have assigned earlier.
