Your entire question is subjective to what one considers "brutally unfair" or even the nature of ganking. Expect equally subjective answers.

I have made some pretty dumb decisions when ganking people before. I've also had times where, when attacking a target on equal grounds, I have lost due to bad Kidney Shots, inability to land a finishing move, or just plain latency issues.
The bottom line is that when as a rogue you lose a fight which was in your pocket, it's humiliating. The other person knows it, and is most likely chuckling at you, but you can't let it stop you from trying to learn or approaching another target.
Sure, the point is to win, but if one doesn't ever target a challenging opponent one will never learn to beat all opponents. Many rogues only attack when they know they're going to win, and while I agree with this strategy in real life or most other things, as a rogue who thrives on world PVP as in the olden days, I have had my fair (and unfair) share of humiliations, glories, and unknowns.
If I die, and know why I lost (couldn't land that Kidney Shot, for example) or if I get away without having killed my target, who is to say I didn't really win where it counts?
It's all subjective.
